Masson sentences defendants during Monday sessions

Judge Richard A. Masson sentenced defendants Monday morning at the Elk County Courthouse. 
Brian J. Leathers, 27, of Johnsonburg, after a request for a hearing Leathers was found to have not violated the terms and conditions of his parole, and therefore the District Attorney's request for parole revocation was denied. Leathers will continue to remain under parole until November 21, 2007 under the same conditions as deemed at the time of sentencing for case number CR-308-2006.
Adam James Arigoni, 20, of St. Marys, plead guilty to one count forgery.  He was sentenced to incarceration at the Elk County Prison for a sentence of no less than 98 days and no more than 12 months, receiving credit for time served starting July 31, 2007.  His parole became effective November 5, he must pay $30 supervision fees, a $500 court fine, $770 restitution, and $274.75 in prosecution fees. He also must provide a DNA sample and pay $250 for the cost of testing.  For CR-152-2006 Arigoni's probation was revoked was sentenced to no less than 30 days and no more than 12 months less one day to run consecutive to his previous case. He must also pay $16.50 for probation revocation filing fee.  Arigoni also plead guilty to one charge of forgery.  He was placed on probation for 12 months consecutive to his previous case and must pay $30 supervision fees, a $500 fine and $274.75 in prosecution fees. There is no restitution and he also must provide a DNA sample and pay $250 for the cost of testing.    
Christopher Allen Steudler, 29, of Johnsonburg, plead guilty to simple assault.  He was sentenced 44 days to 24 months incarceration at Elk County Prison, and received credit from time served with parole starting on November 5.  He must pay $30 supervision fees and $267.25 in prosecution fees. He cannot visit or reside at 928 Silver Creek Rd., Ridgway Township until he obtains and maintains employment and successfully completes a long term drug and rehabilitation program.
Charles Everett Clark, 50, of Virginia Beach, plead guilty to two counts of burglary at occupancies where no persons were present.  A pre-sentence investigation report was ordered and he must supply a DNA sample upon request, the cost of which will be deterred until time of sentencing.  He wills reappear for sentencing on December 3 at 9:00 a.m.
Benjamin M. Goodrow, 25, of St. Marys, received sentencing for the charge of retail theft.  Effective November 5 he will be incarcerated at Elk County prison for 30 days to 18 months.  He must pay $30 supervision fees, a $300 fine, $10 restitution, and $281.25 in prosecution fees. He must also $250 for the cost of testing for a DNA sample that was submitted before sentencing.  He is entitled to participate in work release.
Nathaniel Thomas King, 22, of Ridgway, plead guilty one count theft by unlawful taking or disposition.  He was sentenced to 12 months probation effective immediately.  He must pay $30 supervision fees, a $300 fine and $273.75 in prosecution fees.
He is also to pay restitution of $175, to be split between himself and two other defendants.
Joseph Michael Schneider, 21, of Brockport, plead guilty one count theft by unlawful taking or disposition.  He was sentenced to 12 months probation to run consecutive to current probation for a previous case.  He must pay $30 supervision fees, a $300 fine and $273.75 in prosecution fees. He is also to pay restitution of $175, to be split between himself and two other defendants.
Adam Daniel Lion, 29, St. Marys, plead guilty to five counts theft by deception.  He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than one month or more than three months per count with a credit of time served from August 27, 2007.  He must pay $30 supervision fees, a $150 fine, $600 restitution, and $274.25 in prosecution fees.
He plead guilty to one count of bad checks. He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than five months not more than 12 months to run concurrent with the previous case. He must pay $30 supervision fees, a $150 fine, $1000 restitution, and $425.38 in prosecution fees. Lion also plead guilty to two counts of theft by deception.  He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than one month or more than two months per count, to run consecutive to the previous case.  He must pay $30 supervision fees, a $150 fine, $158.50 restitution, and $267.25 in prosecution fees. He then plead guilty to five counts of theft by deception.  He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than one month or more than three months per count, to run consecutive with the previous case.  He must pay $30 supervision fees, a $150 fine, $257.80 restitution, and $267.25 in prosecution fees.
He plead guilty to nine counts theft by deception.  He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than three month or more than six months per count, to run concurrent to each other and consecutive with the previous case.  He must pay $30 supervision fees, a $150 fine, $1455 restitution, and $425.58 in prosecution fees. He pled guilty to four counts theft by deception.  He is be incarcerated at the State Diagnostic and Classification Center, to serve no less than three month or more than six months per count, to run concurrent to the previous case.  He must pay $30 supervision fees, a $150 fine, $263.48 restitution, and $267.25 in prosecution fees.  His probation was revoked.
Linda Marie Krise, 45, of St. Marys was sentenced effective immediately to 5 years in the Intermediate Punishment program, the first 90 days of which must be served in Elk County prison.  
She must pay $30 supervision fees, a $1500 fine to be divided equally between Elk County and the sate of Pa., and $373 in prosecution fees. In addition she must pay $150 for Phase II countermeasures, $125 for the Influence Offenders program and $35 for the court report network evaluation. She will not have to complete community service and driving privileges were also suspended for 18 months and she must complete all treatment programs before her license will be restored.  
Melinda S. Haller, 31, of St. Marys, plead guilty to one count harassment and was sentenced to six months probation. She must pay $30 supervision fees, a $150 fine, $488.60 and $2,814.84 in restitution, and $274.25 in prosecution fees. Later she was sentenced for ARD and must pay $30 supervision fees, a $100 court fine, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $467.25 in prosecution fees. She must also complete 35 hours of community service with a $7.50 insurance premium. Her driving privileges were also suspended for 30 days and she must complete all treatment programs before his license will be restored.
Valerie A. Mowery, 51, of St. Marys, was sentenced for ARD and must pay $30 supervision fees, $150 for Phase II countermeasures, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $373.25 in prosecution fees. She must also complete 35 hours of community service with a $7.50 insurance premium. Her driving privileges were also suspended for 60 days and she must complete all treatment programs before his license will be restored.
Jamie Marie Wilson, 33, of St. Marys, was sentenced for ARD and must pay $30 supervision fees, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $461.65 in prosecution fees. She must also complete 35 hours of community service with a $7.50 insurance premium.  Her driving privileges were also suspended for 60 days and she must complete all treatment programs before his license will be restored.
Dean E. Frick, 40, of St. Marys, was sentenced for ARD and must pay $30 supervision fees, $100 court fine, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $467.25 in prosecution fees. He must also complete 35 hours of community service with a $7.50 insurance premium.  His driving privileges were also suspended for 30 days and he must complete all treatment programs before his license will be restored.
Stephen Arthur Mallery, 46, of Eugene Oregon, was sentenced for ARD and must pay $30 supervision fees, $100 court fine, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $467.25 in prosecution fees. He must also complete 35 hours of community service with a $7.50 insurance premium.  His driving privileges were also suspended for 30 days and he must complete all treatment programs before his license will be restored.
Kent Charles Brunner, 51, of Winchester Virginia, was sentenced for ARD and must pay $30 supervision fees, $100 court fine, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $466.75 in prosecution fees. He must also complete 35 hours of community service with a $7.50 insurance premium.  His driving privileges were also suspended for 60 days and he must complete all treatment programs before his license will be restored.
Todd Michael Peterson, 36, of Kane, was sentenced for ARD and must pay $30 supervision fees, $100 court fine, $150 for Phase II countermeasures, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $363.25 in prosecution fees. He must also complete 35 hours of community service with a $7.50 insurance premium.  His driving privileges were also suspended for 60 days and he must complete all treatment programs before his license will be restored.
Rachel L. Wickline, 21, of Coraopolis, was sentenced for ARD and must pay $30 supervision fees, $150 for Phase II countermeasures, $100 to the substance abuse fund, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $549.75 in prosecution fees. She must also complete 35 hours of community service with a $7.50 insurance premium. Her driving privileges were also suspended for 60 days and she must complete all treatment programs before his license will be restored.
Judge Richard Mason continued sentencing defendants Monday afternoon at the Elk County Courthouse.
James D. Merat, 28, of Byrnedale, was found to no longer be in contempt of court and a bench warrant was vacated.
Merat also had sentencing on other charges rescheduled for December 3, 2007.
Additionally, Merat faced probation revocation related to a previous charge of possession of drug paraphernalia. He was sentenced to 12 months probation and must also pay $30 supervision fees, $100 to the Act 198 substance abuse fund, a $200 fine, and $299.42 for the cost of prosecution.
William Franklin Frantz, 28, of Dubois, pleaded guilty to retail theft. He was sentenced to incarceration at Elk County Prison for no less than 42 days and no more than 12 months with credit for time served making him eligible for parole. He must also pay $30 supervision fees, a $300 fine, and $478.21 for the cost of prosecution.
Shaun Jablonski, 28, of Dubois, pleaded guilty to two counts of DAI. He was sentenced to no less than one year and no more than two years at a state diagnostic classification center. He must also pay $30 supervision fees, $125 to the Influence Offenders Program, $300 to the Act 198 substance abuse fund, $150 for Phase II countermeasures, $35 for the court report network evaluation, a $2,500 fine with half going to the county of Elk and half going to Ridgway, and $838.67 for the cost of prosecution. He must also complete 50 hours of community service with a $7.50 insurance premium. He also suffered a loss of operating privileges for 18 months. This sentence will be consecutive to a sentence imposed in Clearfield. He is also eligible for boot camp.
Timothy Paul Singer, 34, of Kersey, pleaded guilty to two counts of DAI. He was sentenced to incarceration at Elk County Prison for no less than 5 days and no more than 6 months with the possibility of work release. He must also pay $30 supervision fees, a $300 fine that will be split with one half going to the County of Elk and one half going to the Commonwealth of Pennsylvania, $35 for the court report network evaluation, $125 for the Influence Offenders Program, $100 for the Act 198 substance abuse fund, $150 for Phase II countermeasures, and $443.75 for the cost of prosecution. He also suffered a loss of operating privileges for 12 months. He must also complete 50 hours of community service with a $7.50 insurance premium.
Singer also faced ARD revocation but the motion was withdrawn and his ARD was extended for 6 months.
Michael Thorwart was sentenced to incarceration at Elk County Prison for 35 days with credit for time served since November 3 in response to a bench warrant that was issued in May when he was found to be in contempt of court for failing to appear at an ARD revocation hearing. He was also ordered to pay $62.60 to the Elk County Sheriff’s Department following his release. A hearing on the motion to revoke his ARD was set for December 3.
Josephine M. Beimel, 50, of Saint Marys, pleaded guilty to a charge of false statements. She was placed on probation for 36 months but the $30 monthly supervision fees were not assessed. She also must provide a DNA sample but is not required to pay the $250 fee. She must pay $4,782.94 in restitution and $211.75 for the cost of prosecution.
Joseph Walter Cherry, 24, of Johnsonburg, pleaded guilty to possession of drug paraphernalia. He was sentenced to 12 months probation and must pay $30 supervision fees, a $150 fine, $100 to the Act 198 substance abuse fund, and $273.75 for the cost of prosecution.
Heather Lynn Hulton, 20, of Johnsonburg, withdrew guilty pleas she had previously entered for charges of theft of leased property and theft by deception.
David John Feidler had his sentencing continued until December 3 to allow him time to confer with or retain an attorney.
David A. Brown, 28, of Latrobe, faced ARD revocation but the motion was withdrawn and he was given a six month extension.
Brian Adam Kearney, 21, of Ridgway, pleaded guilty to theft by unlawful taking or disposition. He was placed on probation for 12 months and must pay $30 supervision fees, a $300 fine, $175 in restitution to be split with his codefendants, and $273.75 for the cost of prosecution.
Jeremy Robert Smith, 30, of Ridgway, pleaded guilty to retail theft. He was sentenced to 12 months probation to be served consecutive to another sentence he is currently serving. He also must pay $30 monthly supervision fees, a $100 fine, and $273.75 for the cost of prosecution. He must also attempt to get his GED as a special condition of his probation.
George Andrew Singer, 27, of Emporium, will have his sentencing continued on January 4, 2008.
Justin Tami, 24, of Saint Marys, pleaded guilty to one charge of disorderly conduct. He had to pay a $300 fine and $234.50 for the cost of prosecution. Both amounts had to be paid Monday afternoon and he will face no additional fees or charges.
Joshua Todd Bizzak will have his sentencing continued on January 4, 2008.
