Judge Richard Masson sentenced defendants at yesterday morning's return day.
The first to be sentenced was Benjamin Clyde Gerg, 38, of St. Marys for driving after imbibing, driving on roadways, careless driving, driving at a safe speed and driver required to be licensed. Gerg was sentenced to no less than 72 hours to six months incarceration, $30 monthly supervision fees, $1,000 fine with half to go to Elk County and the other half to the state, $150 influence offenders fee, Act 198 assessment fee of $100, 12-month license suspension and the cost of prosecution in the amount of $376.75. The next to be sentenced was Anthony Roy Asti, 43, of Reynoldsville for possession of a small amount of marijuana, possession of drug paraphernalia and disorderly conduct. Asti was sentenced to 12 months of probation with a $30 monthly supervision fee; also a $300 fine, Act 198 assessment fee of $100 and the cost of prosecution in the amount of $381.79. Glenda Lee Seabolt, 47, of St. Marys was sentenced to 60 days of incarceration, a $500 fine, probation for 12 months with $30 monthly supervision fees, and the cost of prosecution in the amount of $424.25 for habitual offenders and driving while operating privilege is suspended. James Douglas Merat, 29, of Ridgway was sentenced to incarceration at the State Diagnostic Center in Pittsburgh for no less than 18 months and no more than 48 months with credit for time served; a $30 monthly supervision fees, a $500 fine, DNA testing and fees of $250, and cost of prosecution in the amount of $1,152.98. Merat was sentenced for criminal conspiracy and criminal attempt. Jason Alan Brosky, 22, of Ridgway was issued a bench warrant for his arrest. Milly-Jo Marie Calla, 27, of Ridgway's case was continued. Joseph Grant Latham, 30, of Ridgway was sentenced to no less than three months and no more than 24 months incarceration with credit for time served since May 12; a $500 fine, required to submit a DNA sample with fees assessed of $250, cost of prosecution in the amount of $376.61 and $30 monthly supervision fees. Dustin R. Aunkst, 22, of St. Marys was sentenced for the charges of driving after imbibing with no less than 72 hours and no more than six months incarceration with credit time served. He was paroled as of July 4. Aunkst was also sentenced to 12 months probation with a $30 monthly supervision fees, Act 198 assessment fee of $100, community service, and cost of prosecution $995.75. Mark Allen Steffan, 29, of St. Marys was sentenced to 12 months of probation with a $30 monthly supervision fee, a fine in the amount of $300, cost of prosecution $326.25 and restitution to the St. Marys Pharmacy in the amount of $100. Steffan was sentenced because of the offenses of retail theft and receiving stolen property. Ashley J. Thornton, 29, of St. Marys was sentenced to no less than 47 days and no more than 12 months incarceration with credit for time served as of April 29 with $30 monthly supervision fees, cost of prosecution in the amount of $422.61 and a $300 fine was assessed. Willie C. Moore, 27, of Johnsonburg was sentenced for access device fraud, nine counts of burglary, nine counts of criminal trespass, 10 counts of theft by unlawful taking or disposition, and two counts of criminal attempt. Moore's sentencing is concurrent with all charges. He was sentenced to no less than 12 months and no more than 36 months incarceration at the State Diagnostic Center in Pittsburgh with credit for time served since October 2, 2007 and November 21(2007 for CR-380-2007). The court determined Moore to have a financial hardship so no fine was assessed. A $30 monthly supervision fee and the following restitution was assessed: $500 to Johnsonburg Senior Center; $2,312.25 to Erie Insurance; $444.36 to Palo Construction; $500 to Johnny's Original Italian Pizza; $1,914 to National Range Mutual; $459.33 to CCS/Sears, and $100 to Dr. Imprenda. Cost of prosecution in the amount of $274.75 and $459.33 were also assessed. Jane Janis-Mae Fredette, 50, of Ridgway was sentenced for possession of drug paraphernalia. For this offense, Fredette was sentenced to 12 months of probation with $30 monthly supervision fees, Act 198 $100 assessment and cost of prosecution in the amount of $276.75. Sheila Ann Goss, 36, of Ridgway was sentenced for bad checks. This charge was amended and restitution was paid. David F. Pfingslter, 21, of Ridgway was charged with criminal mischief and was sentenced to 24 months of probation for $30 monthly supervision fees, a $300 fine, cost of prosecution $276.75 and restitution in the amount of $4,897 to Bavarian Hills Golf Course. The following offenders were entered into the Accelerated Rehabilitation Disposition. By doing this, the offenders' criminal record will be erased, however it will remain on their driving record. Each offender received a $400 administration fee, six months of probation with a $30 monthly supervision fee, phase two counterparts, cost of prosecution $519.75, $100 substance abuse fee and 35 hours of community service unless noted otherwise. • Jamie Allen Coffman, 28, of Emporium had a blood alcohol content of .25, received a 60-day loss of license. • Travis Arthur Gillespie, 19, of Jane had a BAC of .10, but because minors are prohibited to operate with alcohol, Gillespie received a 90-day loss of license. • Thomas William Fitch, 52, of Ridgway had a BAC of .09. Fitch did not receive a loss of license, but is required to participate in phase two. • Christine Ann Schutz, 34, of St. Marys had a BAC of .26 and received a 60-day loss of license. • Stephen Joseph Tegano, 27, of St. Marys had a BAC of .22 and received a 60-day loss of license. • Adam Lee Weston, 26, of Emporium had a BAC of .21 and received a 60-day loss of license. • Raymond Joseph Meyer, 81, of St. Marys had a BAC of .12 and received a 30-day loss of license. The court decided that Meyer did not have to pay the $100 substance abuse fee due to hardship, and because of his age, he does not have to participate in the 35 hours of community service, and no phase two counterparts. • Stephen Hoyt Stump, 37, of Johnsonburg had a BAC of .18 and received a 60-day loss of license. • Timothy C. Nelson had a BAC of .26 and received a 60-day loss of license. • Laura Lee Valentine had a BAC of .12 and received a 30-day loss of license. The court found an undue hardship for Valentine and was not assessed the substance abuse fee. Judge Richard Mason continued sentencing defendants Monday afternoon at the Elk County Courthouse. Scott Allen Schloder, 37, of Kersey, pleaded guilty to two counts of DAI. He was sentenced to five years in the Intermediate Punishment Program with the first year to be spent incarcerated at Elk County Prison. He must also pay $30 supervision fees, a $2,500 fine with half going to the County of Elk and half to the City of St. Marys, $150 for Phase II Countermeasures, $300 for Act 198, and $680.49 for the cost of prosecution. He already paid for enrollment into the Influence Offenders Program as well as for the Court Report Network Evaluation. He must also perform 50 hours of community service with a $7.50 insurance premium and suffer an 18 month loss of operating privileges. Heidi Lynn Horton, 30, of Kane, had her bail modified from $5,000 straight bail to $5,000 secured by bail bond or 20 percent cash. Christopher P. Novosat, 43, of Johnsonburg, had sentencing continued until August 4. Patrick Charles Robinson, 54, of Ridgway, had sentencing continued until September 2. David A. Brown, 29, of Latrobe, was given two days to provide documentation of his whereabouts regarding why he failed to appear or else a bench warrant will be issued for his arrest. Michael John Swanson, 37, of Kersey, was added to the October jury selection list. Brent M. Barraclough, 35, of Brockway, pleaded guilty to one count of simple assault and two counts of DAI. For the charges of DAI he was sentenced to incarceration at Elk County Prison for 48 hours to six months for each count. He must also pay $30 supervision fees, a $500 fine with half going to the County of Elk and half to the City of St. Marys, $150 for Phase II Countermeasures, and $100 for Act 198. He already paid for enrollment into the Influence Offenders Program and for the Court Report Network Evaluation. . He must also perform 50 hours of community service with a $7.50 insurance premium and suffer a 12 month loss of operating privileges. For the charge of simple assault he was sentenced to incarceration at Elk County Prison for 12 days to 18 months less one day to be served on weekends consecutive to the DAI charges. He must also pay a $300 fine. Additionally, he must pay restitution in the amount of $3,982.59 and $372.25 for the cost of prosecution. Terry A Titchner, 58, of Ridgway, had sentencing continued until August 4. Eugene Fitch, 53, of Johnsonburg, pleaded guilty to the charge of criminal mischief. He was sentenced to incarceration at Elk County Prison for 64 days to 24 months less one day. He must pay $30 supervision fees, restitution in the amounts of $333.86 and $1,000, a $300 fine, and $486.36 for the cost of prosecution. As a special condition of parole he must continue to undergo treatment through Dickinson Mental Health Center's Forensic Outreach Program. Daniel M. Kuhns, 28, of Punxsutawney, failed to appear and a bench warrant was issued for his arrest. Daniel Murphy, 18, of Ridgway, was added to the December jury selection list. Michael Robert Schreiber, 41, of Ridgway, pleaded guilty to the charge of simple assault. He was placed on probation for 12 months and must pay $30 supervision fees, a $300 fine, and $326.75 for the cost of prosecution. Marvin Bernard Richmond, 44, of St. Marys, had sentencing continued until September 2. John Anthony Raspatello, 55, of Wilcox, has charges pending from two separate incidents and was placed on the August and October jury selection lists. Christine Marie Abrahamson must appear on August 4, along with both of her attorneys, for a status conference. Anthony Raymond Ackley, 19, of St. Marys, had sentencing continued to allow him time to submit an application for the assignment of legal counsel. The application must be submitted by July 31. If he fails to submit the application he must appear on August 4. Robert Lee Kustra had his arraignment rescheduled for August 4. Melissa Jean Cornwall, 31, of Johnsonburg, had sentencing continued until August 4. |
