Honorable Richard A. Masson, President Judge sentenced defendants Monday morning at the May regular Return Day.
The first defendant who was sentenced was Jacob Michael Pearson, 24, of Wilcox for a charge of harassment. Pearson was sentenced to a $300 fine. Michael Lee Overly, 31, of Emporium was sentenced for the charge of endangering the welfare of children and was sentenced to 24 months of probation with supervision fees and a $300 fine. Christopher Michael Yetzer, 20, of St. Marys was sentenced for the possession of a controlled or counterfeit substance to 12 months of probation, to run consecutive with a March sentencing, supervision fees, the Act 198 assessment and a $300 fine. Joseph Michael McClain, 26, of Benezette was sentenced for one charge of access device fraud. McClain was sentenced to 18 months of probation with supervision fees and a $300 fine. Darelle J. Close, 22, of St. Marys was sentenced for one charge of simple assault. For this charge, Close was sentenced to 12 months of probation with supervision fees and a $300 fine. Daniel M. Titchner, 30, of St. Marys was sentenced for one charge of theft by deception. For this charge, Titchner was sentenced to 12 months of probation with supervision fees, a $300 fine and to pay restitution to the Ridgway BiLo in the amount of $277.47. Alex William Phillips, 19, of Kersey was sentenced for one charge of criminal trespass. Phillips was sentenced to incarceration no less than 53 days to 24 months plus one day with credit time served, to be paroled May 4 with monthly supervision fees. In addition, Phillips was sentenced to a $500 fine, to pay restitution in the amount of $148.14 to Fair Plan of Pennsylvania and $135 to Barbara Zimmerman along with the requirement to submit a DNA sample. Kevin J. Meyer, 44, of St. Marys was sentenced for one charge of bad checks. For this charge, Meyer was sentenced to probation for 12 months with supervision fees, a $300 fine and restitution to St. Marys Beverage in the amount of $62.50. Kara Lee Biel, 25, of Johnsonburg was sentenced to nine months of probation with supervision fees, a $300 fine and as a special condition to her probation, Masson ordered her to obtain her GED and to participate in the recommended programs by the Elk County Children and Youth Services. Biel was sentenced as a result of one charge of endangering the welfare of children. Richard Philip Wickett, 27, of St. Marys was sentenced for the charge of simple assault. Wickett was sentenced to 12 months of probation with supervision fees and a $300 fine. Kyle A. Bowley, 20, of Wilcox was sentenced for the charge of simple assault to 24 months of probation with supervision fees, a $300 fine and to pay $686.11 to the Victims Compensation program. Steven Ray Hulings, 21, of St. Marys was sentenced for the charge of burglary. Hulings was sentenced to incarceration for five months to 24 months plus one day with credit time served, supervision fees, a $500 fine and to submit a DNA sample. James Michael Biel, 26, of Johnsonburg was sentenced for the charge of endangering the welfare of children. Biel was sentenced to nine months of probation with supervision fees and a $300 fine. Biel was also ordered to cooperate with the Elk County CYS and to participate in the recommended programs. The following individuals were accepted into the accelerated rehabilitative disposition for the charges of driving after imbibing. Each defendant is sentenced to six months of probation, required to participate in the influence offenders program, phase two countermeasures, pay the substance abuse fee and participate in 35 hours of community service unless noted otherwise. Terry Lee Leightley, 55, of Emporium had a blood alcohol content of .15 and received a 30–day loss of license. Stacey Marie Anders, 18, had a BAC of .14 and received a 90–day loss of license. Because Anders is a under the legal drinking age, she also pled guilty to the summary offense of purchase, etc., intoxicating beverage. Thomas Scott Goodreau, 37, of St. Marys had a BAC of .24 and received a 60–day loss of license. Christine M. Woodford, 41, of Ridgway had a BAC of .24 and received a 60–day loss of license. Susan Ida Luchs, 57, of Ridgway had a BAC of .12 and received a 30–day loss of license. Judge Richard Mason continued sentencing defendants Monday afternoon at the Elk County Courthouse. Karen A. Dowd was placed into the ARD program. She was placed on probation for a period of 36 months and must pay $35 supervision fees, a $400 administration fee, restitution in the amount of $2,367.25, and $299.75 for the cost of prosecution. Michael David Parks, 32, of Weedville, pleaded guilty to the charge of simple assault. He was sentenced to incarceration for a period of no less than three months and no more than 24 months at the State Diagnostic and Classification Center in Pittsburgh to be served concurrent to a sentence imposed by the Clearfield County Court of Common Pleas on March 9. He must also pay $35 supervision fees, a $300 fine, and $325.25 for the cost of prosecution. Jennifer Ann Cornwall, 32, of Ridgway, pleaded guilty to one count of DAI. Her sentencing was deferred until July 6, though she must complete her court report network evaluation by June 10. Joshua Louis Pagley, 20, of Clearfield, was placed on the August jury selection list. Nathan Thomas King, 23, of Ridgway, pleaded guilty to two counts of criminal mischief. A forensic evaluation was scheduled and sentencing will be scheduled upon receipt of the results of the evaluation. Melvin Leon Shaw, 20, of Kersey, was placed on the August jury selection list. Shaw was also placed on the October jury selection list for charges relating to another incident. Adam James Geer, 23, of St. Marys, pleaded guilty to possession of drug paraphernalia. He was placed on probation for a period of 12 months to be served consecutive to a sentence imposed in February 2009. He must also pay $35 supervision fees, a $300 fine, $100 for Act 198, and $396.25 for the cost of prosecution. Jacqueline J. Goodman, 35, of St. Marys, was placed on the October jury selection list. Justin Michael Saline, 19, of St. Marys, pleaded guilty to two counts of theft by unlawful taking or disposition. He was placed in the Intermediate Punishment Program for a period of two years with the first 30 days to be spent on house arrest with electronic monitoring. He must also pay $35 supervision fees, restitution in the amounts of $250 and $1,415.30, and $333.25 for the cost of prosecution. Richard Alan Raspatello, 54, of Kersey, pleaded guilty to one count of theft by deception. He was placed on probation for a period of 24 months unless full payment of the restitution was made Monday, in which case he would be placed on probation for a period of six months. He must also pay $35 supervision fees, a $300 fine, restitution in the amount of $1,850, and $333.25 for the cost of prosecution. Scott Jeffrey Gore, 38, of St. Marys, had his sentencing continued until June 1. Emily Marie Haight, 21, of Wilcox, previously pleaded guilty to one count of simple assault. She was sentenced to incarceration at Elk County Prison for a period of no less than 30 days and no more than 24 months less one day with credit for time served. She is also eligible for work release. She must also pay $35 supervision fees, a $1,000 fine, restitution in the amount of $50, and $348.75 for the cost of prosecution.
