Judge Richard Masson presided over the morning session of Plea Day at the Elk County Courthouse. Preston David Miller, 35, of Ridgway pleaded guilty to one misdemeanor count of DAI. He was sentenced to five years in the Intermediate Punishment Program with the first 12 months spent incarcerated at the Elk County Prison. He will have to pay supervision fees of $35 per month, a $2,500 fine, one half apportioned to Elk County, the other half to the borough of Ridgway, a $150 charge for the Influence Offenders Program, the court report network evaluation, a $35 cost, Phase II countermeasures at a cost of $150, the Act 198 assessment at a $100 cost, a loss of his driver’s license for 18 months and prosecution costs of $476.75. Brian Matthew Stahl, 25, of Byrnedale pleaded guilty to a misdemeanor charge of theft from a motor vehicle and a felony charge of burglary. He will be sentenced in August after a pre-sentence report is prepared. Michael Wayne Terwilliger, 38, of Ridgway pleaded guilty to two misdemeanor charges of simple assault. He was sentenced to a combined 12-30 months incarceration at the state diagnostic and classification center in Pittsburgh, $35 supervision fees per month, a $300 fine and prosecution costs of $325.25.
The victim in the simple assault, Lisa Terwilliger, spoke in front of the court about her experience and her fear of Michael Terwilliger, saying she was afraid he would hurt her again. Michael took responsibility for his actions but said he had been under the influence of alcohol when the incident took place. Judge Masson urged Michael Terwilliger to get into some sort of alcohol treatment plan after his sentence ends. He is to also have no contact with Lisa Terwilliger as part of the terms of his sentence. Jarit Spencer Thomas, 29, of Ridgway pleaded guilty to one misdemeanor charge of escape. He was sentenced to 18 months probation, a $300 fine, $35 supervision fees per month and prosecution costs of $333.75. Racheal S. Weisner, 35, of St. Marys pleaded guilty to one misdemeanor count of false statements. She was sentenced to 24 months probation, $35 supervision fees per moth, a $300 fine, prosecution costs of $213.25 and ordered to pay $2,582.14 in restitution to the Office of the Inspector General. Edward J. Olewinski, 35 of Johnsonburg, pleaded guilty to misdemeanor charges of defiant trespass and criminal mischief. He was sentenced to 34 days to 12 months of incarceration at the Elk County Prison, with credit for time served so he would be paroled Monday. He was also sentenced to 12 months probation, $35 supervision fees per month, ordered to pay $515 in restitution to Dennis Glover and prosecution costs of $275.25. John Curtis Walker, 23, of Johnsonburg pleaded guilty to one misdemeanor count of endangering the welfare of children. He was sentenced to 12 months probation, a $300 fine, $35 in supervision fees per month and prosecution costs of $326.75. Matthew Mikel Silvis, 21, of Falls Creek pleaded guilty to two counts of DAI. He was sentenced to five years in the Intermediate Punishment Program with the first 90 days spent in the Elk County Prison, served on weekends. He will pay supervision fees of $35 per month, pay $150 for entry into the Influence Offenders Program, pay a $1,500 fine, apportioned between Elk County and the Commonwealth of Pennsylvania, pay $300 for the Act 198 assessment, $50 for the court report network evaluation, must do 50 hours of community service with a $7.50 insurance premium, Phase II countermeasures at a cost of $150, prosecution costs at $484.25. He will lose his driver’s license for 18 months. The case of Todd James Asti, 21, of Ridgway was added to the December 2009 jury selection list. The case of Nicole Rebecca Dubeck, 19, of Weedville was also added to the December jury selection list. The case of Bobby Lee Carlson, 41, of Kane was added to the August 2009 jury selection list. The case of Benjamin Clye Gerg, 31, of St. Marys was added to the August 2009 jury selection list. Jamie J. Kronenwetter, 32, of Kersey along with Kristal Kathleen Oknefski, 27, of Ridgway, Jared Michael Freeburg, 21, of Ridgway, Mark A. Seabolt, 42, of Ridgway, Andrew Lynn Adams, 20, of Bethel, Sasha Marie Myers, Dodie Jean Mercer, 26, of Ridgway, Rick David Neville of Killbuck, Ohio, Gary William Stewart, 52, of St. Marys, Tiffany Lynn Nero, 24, of St. Marys and Scott Adam Keller, 27, of St. Marys were all among those admitted to ARD. Oknefski, Freeburg and Stewart will lose their driver’s licenses for 30 days. Adams, Neville and Nero lose their license for 60. Keller and Mercer will not lose their license because their BAC was below 0.1. The case of Mark Stolberg, 51, of Ridgway was added to the October 2009 jury selection list. He was placed on probation for a period of 12 months to be served consecutive to an ARD sentence he is currently serving. He must also pay $35 supervision fees, a $300 fine, and $333.25 for the cost of prosecution. Dustin Allen Courteau, 21, of St. Marys pleaded guilty to the charge of possession with intent to manufacture or deliver. He was sentenced to incarceration at Elk County Prison for a period of no less than 30 days and no more than 24 months less one day with credit for time served of 13 days. He must also pay $35 supervision fees, a $300 fine, $100 for Act 198, restitution in the amount of $50, and $396.25 for the cost of prosecution. He is also required to provide a DNA sample and pay the $250 testing assessment fee. As a special condition of his parole he must also attempt to obtain his GED. Courteau also pleaded guilty to the charges of possession of a controlled or counterfeit substance and purchase, etc. of intoxicating beverage. He was placed on probation for a period of 12 months to be served consecutive to his previous sentence. He must also pay $35 supervision fees, $100 for Act 198, a $300 fine, and $572.25 for the cost of prosecution. He must also agree to the forfeiture of any money seized as a result of the incidents. As a special condition of his probation he must also make an effort to earn his GED. Courteau also pleaded guilty to the charge of simple assault. He was placed on probation for a period of 24 months to be served consecutive to his previous sentence. He must also pay $35 supervision fees, a $300 fine, and $333.25 for the cost of prosecution. As a special condition of his probation he must also attempt to earn his GED. Courteau also pleaded guilty to the charge of possession of a small amount of marijuana for personal use. He was placed on probation for a period of 30 days to be served consecutive to his previous sentences. He must also pay $35 supervision fees, $100 for Act 198, a $100 fine, and $396.25 for the cost of prosecution. As a special condition of his probation he must also make an effort to obtain his GED. Robert Herrick Pearslall, 20, of St. Marys pleaded guilty to the charge of receiving stolen property. His sentencing was deferred until a restitution hearing is conducted. Jeanette Christine Schiel, 35, of Sinnamahoning had her sentencing continued until the July 6 return day. Joshua David Erich, 18, of St. Marys pleaded no contest to the charge of simple assault. He was placed on probation for a period of 12 months and must pay $35 supervision fees, a $300 fine, restitution in the amounts of $2,605.03 and $220.27, and $333.25 for the cost of prosecution. Amanda Dawn Eckl, 30, of Ridgway pleaded no contest to the charge of indecent assault. Her sentencing was deferred until a pre-sentence investigation is completed along with a mental health forensic investigation. She must also submit a DNA sample with the cost deferred until the time of sentencing. Julie Marie Nortum, 29, of St. Marys had her probation revoked for charges relating to false reports to law enforcement. She as re-sentenced to enrollment in the Intermediate Punishment Program for a period of 12 months. She must also pay $35 supervision fees, a $150 fine, and $343.25 for the cost of prosecution. Nortum also had her probation revoked for charges related to theft from a motor vehicle. She was re-sentenced to enrollment in the Intermediate Punishment Program for a period of 12 months to be served consecutive to her previous sentence. She must also pay $35 supervision fees, a $150 fine, restitution in the amount of $175, and $343.25 for the cost of prosecution. Nortum also pleaded guilty to the charge of possession of drug paraphernalia. She was enrolled in the Intermediate Punishment Program for a period of 12 months to be served consecutive to her previous sentence. She must also pay $35 supervision fees, a fine, $100 for Act 198, and $711.25. Scott Jeffrey Gore, 38, of St. Marys had cases placed on the December and February jury selection lists.
