Many sentenced by Judge Masson at Return Day

Judge Richard Masson presided over sentencing various defendants Monday morning at the Elk County Courthouse. 

Ronald Lee Gleixner, 52, of Weedville, pleaded guilty to one count of possession of child pornography. He will be put in front of the sexual offenders board and sentenced at a later date.

Lopez Anthony Robison, 52, of St. Marys pleaded guilty to one count of simple assault. He was sentenced to incarceration at the Elk County Prison for a period of 14 days to 12 months with credit for time served so he was paroled that day. He must pay $35 supervision fees per month, prosecution costs of $275.25 and a $300 fine.

Nathan Thomas King, 24, of Ridgway, pleaded guilty to two counts of criminal mischief. For the first count, he was sentenced to 7-24 months less one day incarceration at the Elk County Prison with work release. For the second count, he was placed on probation for 24 months. He must pay $35 supervision fees per month, prosecution costs of $370.25, a $500 fine, restitution of $265.21 to Andrew Caya and $4,775.10 to Sarah Winter.

Timothy Alan Rhoads, 29, of Ridgway, pleaded guilty to two counts of DAI. His blood alcohol level was .405. He was sentenced to between 72 hours and six months of incarceration at the Elk County Prison for each count. He must pay $35 supervision fees per month, a $1,000 fine split between Elk County and the borough of Ridgway, $150 for Phase II countermeasures, 50 hours of community service with a $7.50 insurance premium, prosecution costs of $333.75 and a loss of license for 12 months. He already paid for entry into the Influence Offenders Program and for Court Report Network Evaluation.

Robert G. Wittman, 63, of Ridgway, pleaded guilty to charges of DAI. He was placed in the Intermediate Punishment Program for five years with the first 90 days incarcerated in the Elk County Prison. He must pay $35 supervision fees, a $1,500 fine split between Elk County and the borough of Ridgway, prosecution costs of $484.25, the Act 198 assessment at a cost of $300, $150 for entry into the Influence Offenders Program, a cost of $150 for Phase II countermeasures and he will lose his driver’s license for 18 months.

Jason Paul McCandless, 34, of St. Marys, pleaded guilty to one count of criminal trespass. He was placed on 12 months probation. He must pay a $300 fine, prosecution costs of $305.25 and supervision fees of $35 per month.

Johnathan Glen Surginer, 18, of Johnsonburg pleaded guilty to one count of possession of drug paraphernalia. He was placed on 12 months probation and must pay $35 supervision fees, a $300 fine, the Act 198 assessment at a cost of $100 and prosecution costs of $283.75.

Christopher Michael George, 30, of McKees Rocks pleaded guilty to one count of criminal mischief. He was sentenced to a period of 58 days to 12 months of incarceration at the Elk County Prison with credit for time served so he was paroled that day. He must pay restitution of $300 to the city of St. Marys, $35 supervision fees and prosecution costs of $351.62.

Nicole L. Cleaver, 25, of Ridgway will be sentenced after a pre-sentence investigation is done.

A bench warrant was issued for Eric J. Leslie.  

Brian Matthew Stahl, 25 of Byrnedale, Christine Marie Abrahamson, 41, of Wilcox and Sarah Angeline Pettit, 25, of Johnsonburg, were granted continuances. Karolee M. Crotzer, 48, of Johnsonburg was granted a continuance until a restitution hearing can be held.

Randy L. Radaelli, 51, of St. Marys had a continuance granted until Aug. 3. Chelsey Jayne Trumbull, 19, of Ridgway had her case placed on the December jury selection list. Paul E. Myers, 29, of St. Marys had his case placed on the October jury selection list.

Richard Paul Snyder, 25, of Shippenville, Nicole Elizabeth Zappia, 27, of Ridgway, Sasha Marie Myers, 21, of Wilcox, Scott Phillip Maley, 48, of McKeesport and Thomas William Barnett, 38, of Ridgway were entered into ARD. Everyone except Zappia will lose their license for 60 days and enter into Phase II countermeasures. Zappia will lose her license for 30 days and not enter into Phase II.

Judge Richard Mason continued sentencing defendants Monday afternoon at the Elk County Courthouse.

Jessica May Steger, 24, of Ridgway, pleaded guilty to one count of DAI. She was sentenced to incarceration at Elk County Prison for a period of no less than 72 hours and no more than 6 months. She must also pay $35 supervision fees, a $1,000 fine with half going to the County of Elk and half to the Commonwealth of Pennsylvania, $150 for Phase II Countermeasures, $100 for Act 198, and $438.75 for the cost of prosecution. She already paid for entry into the Influence Offenders Program and for her Court Report Network Evaluation. She must also perform 50 hours of community service with a $7.50 an hour insurance premium. She must also suffer a loss of operating privileges.

Daniel Andrew Cherry, 31, of Johnsonburg, pleaded guilty to the charges of possession with intent to manufacture or deliver a controlled substance and simple assault. For the charge of possession with intent to manufacture or deliver he was sentenced to incarceration at the State Diagnostic and Classification Center in Pittsburgh for a period of no less than 24 months and no more than 72 months. For the charge of simple assault he was sentenced to incarceration at the State Diagnostic and Classification Center in Pittsburgh for a period of no less than 12 months and no more than 24 months to be served concurrent to his previous sentence. He must also pay $35 supervision fees, a $500 fine, $100 for Act 198, and $333.25 for the cost of prosecution.

Tyler Lee Rieder, 25, of St. Marys, was placed on the October jury selection list.

Jennifer Ann Cornwall, 32, of Ridgway, previously pleaded guilty to one count of DAI. She was sentenced to enrollment in the Intermediate Punishment Program for a period of five years with the first 90 days to be spent incarcerated at Elk County Prison. She must also pay $35 supervision fees, a $1,500 fine with half going to the County of Elk and half to the Commonwealth of Pennsylvania, $100 for Act 198, $150 for Phase II Countermeasures, and $491.25 for the cost of prosecution. She already paid for entry into the Influence Offenders Program and for her Court Report Network Evaluation. She must also perform 50 hours of community service with a $7.50 an hour insurance premium. She must also suffer an 18 month loss of operating privileges.

Carrie Lynn Singer, 31, of St. Marys, was placed on an upcoming jury selection list.

Travis L. Lecker, 26, of Ridgway, pleaded guilty to the charge of harassment. He must pay restitution in the amount of $2,829.72, a $300 fine, and $248 for the cost of prosecution.

Timothy John Smith, 33, of St. Marys, pleaded guilty to one count of DAI. He was placed in the Intermediate Punishment Program for a period of five years with the first 12 months to be spent incarcerated at Elk County Prison with the potential for work release. He must also pay $35 supervision fees, a $2,500 fine with half going to the County of Elk and half to the City of St. Marys, $100 for Act 198, $150 for Phase II Countermeasures, restitution in the amount of $697.45, and $483.25 for the cost of prosecution. He already paid for entry into the Influence Offenders Program and for his Court Report Network Evaluation. He must also perform 50 hours of community service with a $7.50 an hour insurance premium. He must also suffer an 18 month loss of operating privileges.

Dennis J. Dornish, 37, of St. Marys, pleaded guilty to two counts of DAI. He was sentenced to enrollment in the Intermediate Punishment Program for a period of five years with the first 12 months to be spent incarcerated at Elk County Prison with the potential for work release. He must also pay $35 supervision fees, a $2,500 fine with half going to the County of Elk and half to the City of St. Marys, $150 for enrollment in the Influence Offenders Program, $50 for his Court Report Network Evaluation, $300 for Act 198, $150 for Phase II Countermeasures, and $590.75 for the cost of prosecution. He must also perform 50 hours of community service with a $7.50 an hour insurance premium. He must also suffer an 18 month loss of operating privileges.

William Robert Foley, 26, of St. Marys, pleaded guilty to two counts of DAI. He was sentenced to enrollment in the Intermediate Punishment Program for a period of five years with the first 90 days to be spent incarcerated at Elk County Prison. He must also pay $35 supervision fees, a $1,500 fine with half going to the County of Elk and half to the City of St. Marys, $150 for enrollment in the Influence Offenders Program, $50 for his Court Report Network Evaluation, $300 for Act 198, $150 for Phase II Countermeasures, and $498.75 for the cost of prosecution. He must also perform 50 hours of community service with a $7.50 an hour insurance premium. He must also suffer an 18 month loss of operating privileges.

Thomas Anthony Doan, 40, of St. Marys, pleaded guilty to the charge of simple assault. He was placed on probation for a period of 24 months and must pay $35 supervision fees, restitution in the amounts of $50 and $278.50, a fine, and $333.75 for the cost of prosecution.

Michael David Schaut, 19, of St. Marys, pleaded guilty to the charge of possession of drug paraphernalia. He was placed on probation for a period of 12 months and must pay $35 supervision fees, $100 for Act 198, a $300 fine, and $459.25 for the cost of prosecution.

Joshua S. Dalton, 19, of Ridgway, pleaded guilty to the charge of simple assault. He was placed on probation for a period of 12 months and must pay $35 supervision fees, a $300 fine, and $333.25 for the cost of prosecution.

Eric J. Leslie had a bench warrant issued for his arrest on Monday morning after he failed to appear at the Elk County Prison. He appeared in court on Monday afternoon where his appointed attorney withdrew. A new attorney will be appointed for Leslie at a later date. Leslie was then remanded to Elk County Prison.

James Edward Dickant, 19, of Ridgway, had cases placed on the October 2009 and February 2010 jury selection lists.

Adam James Arigoni, 21, of St. Marys, pleaded guilty to two counts of simple assault. His sentencing was continued until the September return day.

The attorney for Timothy Lee Samick, 39, of Ridgway, failed to appear though Samick was present. Samick’s sentencing was rescheduled for the August return day.

Devin Thomas Lecker, 23, of St. Marys, pleaded guilty to the charges of possession of drug paraphernalia and driving while operating privileges are suspended or revoked. For the possession charge he was placed on probation for a period of 12 months and must pay a $300 fine. For the charge of driving while operating privileges are suspended or revoked he must pay a $200 fine and suffer an additional loss of operating privileges as noted by PennDOT. He must also pay $35 supervision fees, $100 for Act 198, and $323.25 for the cost of prosecution. As a special condition of his probation he must attempt to obtain his GED.
