The Honorable Richard A. Masson, President Judge presided over the morning session of Return Day at the Elk County Courthouse.
The first case heard was a preliminary arraignment of Amber Silk. Silk violated a temporary Protection From Abuse order and had her hearing continued until today. Bail was established at $1,000 unsecured for the offense of Indirect Criminal Contempt. Kelly Jo Newlon, 30, of St. Marys entered a guilty plea for the charge of Criminal Trespass, a third-degree misdemeanor. Newlon was sentenced to no less than 30 days and no more than 12 months in Elk County Prison, was not offered work release, must pay a $300 fine, pay $35 monthly supervision fees and pay $333.75 for prosecution and is to have no contact with the victim. David Paul Dilley, 45, of St. Marys entered a guilty plea for Criminal Mischief and Possession of Drug Paraphernalia. For the Criminal Mischief charges, he received a sentence of no less than 91 days and no more than 21 months in Elk County Prison and will receive work release as he is employable. For the offense of Possession of Drug Paraphernalia, Dilley was sentenced to 12 months probation consecutive to his sentence, pay a $300 fine, pay $100 for Substance Abuse Education, pay $35 in monthly supervision fees and pay $1,204 restitution to Comfort Inn of St. Marys and pay $698.25 for prosecution. Gina Marie Ritter, 25, of St. Marys appeared before Judge Masson. Ritter's attorney, Shawn T. McMahon, withdrew his representation of Ritter. Scott Dalton Fisher, 53, of Wellsboro had his case sent to jury selection on Dec. 14 at 9 a.m. in the main courtroom of the Elk County Courthouse on three counts of burglary, five counts of criminal conspiracy and two theft by unlawful taking or disposition charges and one count of criminal attempt. Nicole L. Cleaver, 25, of Ridgway entered a guilty plea for selling or furnishing liquor or malt or brewed beverages to minors. Cleaver was sentenced to no less than 90 days and no more than one year in Elk County Prison, pay a $1,000 fine, pay $35 in monthly supervision fees and $283.75 for the cost of prosecution. The victims in the case were 14-years of age. Jeremiah John Wickett, 33, of Ridgway entered a guilty plea for Disorderly Conduct. He was sentenced to 12 months probation, pay $35 in monthly supervision fees, a $300 fine and $275 for the cost of prosecution. Jesse John Gardner, 26, of St. Marys entered a guilty plea for the offense of Possession of Drug Paraphernalia. He was sentenced to 12 months probation, will pay $35 in monthly supervision fees, a $150 fine, pay $100 to Substance Abuse Education, and $418.75 for the cost of prosecution. Alica M. Sidelinger, 19, of Byrnedale entered a guilty plea for Criminal Mischief and Obstructing the Administration of Law or other government function. For Criminal Mischief, Sidelinger was sentenced to 12 months probation, pay $35 in monthly supervision fees, a $300 fine, pay $681.30 in restitution to the victim and $291 for the cost of prosecution. For the offense of Obstructing the Administration of Law or other government function, Sidelinger was sentenced to 12 months probation consecutive to the probation received from the Criminal Mischief offense, pay $35 in monthly supervision fees, a $300 fine and $333.25 for the cost of prosecution. Judge Masson also put a special condition into the sentence that Sidelinger make an effort to obtain her General Equivalency Diploma while on probation. Brandon James Yetzer, 29, of St. Marys entered a guilty please for the charge of Possession of Drug Paraphernalia. Yetzer was sentenced to 24 months probation, must pay $35 in monthly supervision fees, a $400 fine, $250 in restitution to the victim, $1415.30 to National Insurance Co. and $333.25 for the cost of prosecution. As a special condition to the sentence, Judge Masson ordered Yetzer earn his high school diploma or earn his GED while on probation. Bryant Daniel Kinkead, 37, of Johnstown, had his case for Harassment put on the jury selection list. William Paul Cherry, 44, of St. Marys had his case for Failure to Comply with Registering of Sex Offenders put on the jury selection list. Christine Marie Abrahamson, 42, of Wilcox has her case put on the jury selection list. Abrahamson faces two charges of Arson and Related Offenses, Recklessly Engandering Another Person and Disorderly Conduct. Cody James Sheasley, 19, of Ridgway entered a guilty plea for the charges of Simple Assault. He was sentenced to 12 months probation, pay $35 in monthly supervision fees, pay a $300 fine, pay restitution in the amount of $377.49 to the Victim's Compensation Assistance Program and pay $333.75 for the cost of prosecution. Donna M. Sorg, 49, of Kersey entered a guilty plea for two counts of bad checks. Sorg was sentenced to 12 months probation for each count, a total of 24 months, pay $35 in monthly supervision fees, a $300 fine, $1,250 in restitution to the Ridgway Eagles and $283.75 for the cost of prosecution. Gary Lee Pashong, 27, of St. Marys had his case rescheduled for the Oct. 5 Return Day session. Pashong is charged with Burglary, Criminal Conspiracy, Criminal Trespass, Theft by Unlawful Taking or Disposition and Receiving Stolen Property. Heather Lynn Hulton, 22, of St. Marys entered a guilty plea for forgery and Escape. For the Escape, Hulton was sentenced to 12 months probation, pay $35 in monthly supervision fees, a $300 fine and $333.25 for the cost of prosecution. For the forgery offense, Hulton was sentenced to 36 months probation, a total of 48 months for both offenses, pay $35 in monthly supervision fees, a $500 fine, pay $250 for the submission of a sample of DNA and $738.07 for the cost of prosecution. Kayla Marie Huff, 20, of DuBois entered a guilty plea for the charge of Theft by Deception and Bad Checks. Huff was sentenced to 12 months probation, must pay $35 in supervision fees, a $300 fine, restitution in the amount of $184.77 to Fairview Fuel and $556.15 for the cost of prosecution. As a special condition, Judge Masson ordered that Huff obtain her GED while on probation. Michael Norman Depto, 42, of Kane was accepted into the ARD program on the charges of Harassment. He was given 12 months probation and is to have no contact with the victim. He also must pay $35 in supervision fees, perform 35 hours of community service and pay the $7.50 insurance premium. Mark David Lenze, 49, of Johnsonburg, was accepted into the ARD program from the charges of Terroristic Threats. He was sentenced to 12 months probation, must pay $35 in supervision fees, perform 35 hours of community service and pay the $7.50 insurance premium. Lenze must also attend an Anger Management Program at his own expense. Tamara Ann Dowd, 29, of Ridgway was accepted into the ARD program. She was sentenced to six months probation, must pay $35 in monthly supervision fees, perform 35 hours of community service and pay the $7.50 insurance premium. Amanda Jean Sidelinger, 21, of Byrnedale entered a guilty plea for Resisting Arrest. She was sentenced to 24 months probation, must pay $35 in supervision fees, a $300 fine and $333.25 for the cost of prosecution. David James Kennedy, 29, of Ridgway entered a guilty plea for Possession of Drug Paraphernalia. He was sentenced to 12 months probation, must pay $35 in monthly supervision fees, a $300 fine, $100 for Substance Abuse Education and $283.75 for the cost of prosecution. Barbara Jean Wall, 74, of Ridgway was accepted into the ARD program. She will suffer a 30-day loss of license and will perform community service. She was also enrolled in Phase I countermeasures. Jeffrey Hansen Cote, 30, of St. Marys was accepted into the ARD program. He will suffer a 60-day loss of license and will enter Phase II countermeasures and pay the costs. Scott M. Clever, 43, of Brockport has a motion granted to modify the conditions of his bail. His bail was set at $2,500 unsecured. Judge Richard Masson continued sentencing defendants Monday afternoon at the Elk County Courthouse. Robert Herrick Pearsall, 20, of St. Marys, was sentenced after previously having pleaded guilty to the charge of Receiving Stolen Property. He was placed on probation for a period of 18 months and must pay $35 supervision fees, a $300 fine, and $342.79 for the cost of prosecution. Victoria Jean Gordon, 25, of Johnsonburg was granted the request of the withdrawal of her council. Dean Frick pleaded guilty to one count of DAI and to the charge of Possession of Drug Paraphernalia. For the DAI offense he was sentenced to enrollment in the Intermediate Punishment Program for a period of five years with the first 90 days to be spent incarcerated at Elk County Prison with the potential for work release. For the possession offense he was sentenced to 12 months in the Intermediate Punishment Program to be served consecutive to the first sentence. He must also pay $35 supervision fees, a $1,500 fine with half going to the County of Elk and half to the City of St. Marys, $100 for Act 198, $150 for Phase II Countermeasures, restitution in the amount of $517, and $871.25 for the cost of prosecution. He previously paid for enrollment in the Influence Offenders Program and for his court report network evaluation. He must also complete 50 hours of community service with a $7.50 insurance premium. Additionally, he must suffer an 18-month loss of operating privileges. Jeanette Christine Schiel, 35, of Emporium, had her sentencing continued until the Oct. 5 return day. Joshua Paul Padasak, 28, of Johnsonburg, pleaded guilty to the charge of Aggravated Assault. He was sentenced to a period of incarceration at Elk County Prison of no less than nine months to no more than 24 months less one day with credit for time served. He must also pay $35 supervision fees, a $500 fine, and $333.25 for the cost of prosecution. He must also submit a DNA sample and pay the testing assessment fee of $250. Kurt Michael Brennen, 42, of Ridgway, pleaded guilty to two counts of DAI. He was sentenced to enrollment in the Intermediate Punishment Program for a period of five years with the first 90 days to be spent incarcerated at Elk County Prison with the potential for work release. For the charge of simple assault, she was sentenced to a period of incarceration at Elk County Prison for a period of no less than 30 days and no more than 18 months. For the charge of Criminal Trespass, she was placed on probation for a period of 12 months to be served consecutive to her previous sentence. She must also pay $35 supervision fees, a $300 fine, and $325.25 for the cost of prosecution. Jared Lee Hulton, 24, of Johnsonburg, had his sentencing continued until the Nov. 2 Return Day. Timothy Lee Samick, 39, of Ridgway, pleaded guilty to the charge of Simple Assault. He was placed on probation for a period of 12 months and must pay $35 supervision fees, a $300 fine, and $340.25 for the cost of prosecution. Adam James Arigoni, 21, of St. Marys, previously pleaded guilty to two counts of Simple Assault. For the first count he was sentenced to incarceration at the Elk County Prison for a period of no less than 60 days and no more than 24 months less one day. For the second count he was placed on probation for a period of 12 months to be served consecutive to his pervious sentence. He must also pay $35 supervision fees, a $300 fine, and $333.25 for the cost of prosecution. Thomas James Schreiber, 29, of St. Marys, previously pleaded guilty to charges of DAI in Sept. 2008. He returned for imposition of sentencing on Monday and it was stated that all terms of the original order shall continue in full force. He must serve a sentence of incarceration at Elk County Prison of no less than 30 days and no more than six months and is entitled to academic release in order to continue to attend class at Penn State University’s DuBois campus. Timothy Thomas Hooper, 44, of Kersey, pleaded guilty to two counts of DAI. He was sentenced to incarceration at Elk County Prison for a period of no less than 30 days and no more than six months for each count with the sentences to be served concurrently. He must also pay $35 supervision fees, a $750 fine, $100 for Act 198, $150 for Phase II Countermeasures, and $480.75 for the cost of prosecution. He previously paid for enrollment into the Influence Offenders Program and for his court report network evaluation. He must also complete 50 hours of community service with a $7.50 insurance premium. Additionally, he must suffer a 12-month loss of operating privileges. Sarah Angeline Petitt, 25, of Johnsonburg, pleaded guilty to Possession of Drug Paraphernalia. She was placed on probation for a period of 12 months to be served consecutive to a sentence previously imposed in Cameron County. She must also pay $35 supervision fees, $100 for Act 198, and $283.25 for the cost of prosecution. Brian Matthew Stahl, 25, of Weedville, pleaded guilty to the charges of Theft from a Motor Vehicle and burglary. For the offense of burglary he was sentenced to incarceration at the State Diagnostic Classification Center in Pittsburgh for a period of no less than 18 months and no more than 60 months with the potential for a recidivism risk reduction incentive. He must also pay $35 supervision fees, a $500 fine, and $333.75 for the cost of prosecution. He also was required to submit a DNA sample and pay the testing and assessment fee of $250. For the charge of Theft from a Motor Vehicle, he was sentenced to incarceration for a period of no less than two months and no more than 12 months to be served concurrent to his previous sentence also has the potential for a recidivism risk reduction incentive. He must also pay $35 supervision fees, a $300 fine, restitution in the amount of $55, and $276.75 for the cost of prosecution. Albert L. Anderson, 38, of Kersey, had his sentencing continued until the Oct. 5 return day.
