Judge Masson presides over Return Day

President Judge Richard A. Masson presided over Return Day yesterday at the Elk County Courthouse.

James Edward Dickant, 20, of Ridgway was sentenced incarceration at State Diagnostic Classification Center in Pittsburgh for not less than 12 months and not more than 24 months for the charge of theft by deception, with credit for 239 days served. Upon parole, he must pay $35 in monthly supervision fees, a $150 fine, restitution on monthly installments and $335.75 for the cost of prosecution. For a burglary charge, he must pay the cost of prosecution in the amount of $335.25, a $500 fine, submit at DNA sample at a cost of $250, to be served concurrent to the theft by deception charge. He was ruled ineligible for the recidivism risk reduction program.

Carrie Ann Kline, 34, of Kersey was sentenced to 30 days probation for possession of a small amount of marijuana for personal use. She must pay $35 in monthly supervision fees, a $100 fine, $100 to the substance abuse education program and $595.75 for the cost of prosecution.

Bernadett Marie Lyons, 38, of Ridgway was sentenced to 24 months probation for theft by unlawful taking. She must pay $35 in monthly supervision fees, a $300 fine, $200 in restitution to Goodwill and $335.25 for the cost of prosecution.

Robert James Lyons, 25, of Ridgway was also charged with 24 months probation for theft by unlawful taking. He must pay $35 in monthly supervision fees, a $300 fine, $200 in restitution to Goodwill and pay $335.25 for the cost of prosecution. He was also sentenced to six months probation to be served consecutive to the theft by unlawful taking sentence. He must also pay $35 in monthly supervision fees, a $150 fine and $287.75 for the cost of prosecution.

Rodney Wayne Bump, 41, of Ridgway had his case for theft by unlawful taking or disposition and receiving stolen property placed on the April Jury Selection list.

Richard John Farabaugh, 49, of St. Marys was sentenced to not less than 30 days and not more than six months, one for each count, on two counts of DAI. He was granted work release, must pay $35 in monthly supervision fees, a $750 fine, with half going to the County of Elk and half to the Commonwealth of Pennsylvania, $150 to the Influence Offenders Program, $100 to Substance Abuse education and $150 for Phase II countermeasures. He must also perform 50 hours of community service and pay the $7.50 insurance premium. He will lose his driver's license for a period of 12 months and must complete all treatment programs before he can apply to get his license back. He must also pay the cost of prosecution in the amount of $497.25.

Lawrence Edward Wittman, 44, of Dagus Mines was admitted into the Intermediate Punishment Program for five years and is to serve 90 days incarceration at Elk county Prison for two counts of DAI. He was granted work release. He must pay $35 in monthly supervision fees, a $1,500 fine with half going to the County of Elk and half to the City of St. Marys. He must also pay $150 to the Influence Offenders program, $300 to Substance Abuse education and $150 for Phase II countermeasures. He must perform 50 hours of community service and pay the $7.50 insurance premium. He will lose his license for 18 months and must complete all treatment programs before he can apply to get his license back. He must also pay the cost of prosecution in the amount of $497.25.

Susan Marie Lion, 46, of St. Marys will be sentenced for two counts of DAI on March 1 at 10:30 a.m.

Robert Glenn Beck, 59, of Ridgway payed a $100 fine for one count of bad checks. He also must pay the cost of prosecution of $243.

Barry Neil Keslar, 59, of Ridgway was admitted into the Intermediate Punishment Program for five years. He must also serve 90 days in Elk County Prison. Upon parole, he must pay $35 in monthly supervision fees, a $1,500 fine with half going to Ridgway Borough and half going to the County of Elk. He must also pay $150 to the Influence Offenders program, $300 to Substance Abuse education, $150 for Phase II countermeasures, must perform 50 hours of community service and pay the $7.50 insurance premium. He will lose his license for 18 months and must complete all treatment programs before he can apply to get his license back. He must also pay the cost of prosecution in the amount of $385.75.

Christopher Alan Steudler, 31, of St. Marys will have his case for unauthorized use of automobile or other vehicle rescheduled.

Willis Russell Jordan, 30, of Johnsonburg will have his case for contraband-controlled substances, contraband, contraband other than controlled substance and possession of a controlled or counterfeit substance rescheduled.

John Edward Stumpf, 50, of Ridgway was accepted into the ARD program on a charge of violations of use of certificate of inspection. He was sentenced to six months probation, must pay $35 in monthly supervision fees, perform 35 hours of community service and pay the $7.50 insurance premium. He must also pay $400 in administrative costs, $200 in fines and $441.75 for the cost of prosecution.

Kenneth Roger Shaffer, 61, of Johnsonburg was accepted into the ARD program on a charge of violations of use of certificate of inspection. He was sentenced to six months probation, must pay $35 in monthly supervision fees, perform 35 hours of community service and pay the $7.50 insurance premium. He must also pay $400 in administrative costs, $200 in fines and $441.75 for the cost of prosecution.

Steven Edward Smith, 53, of Kersey was accepted into the ARD program on a charge of use of certification of appointment at official inspection station. He was sentenced to six months probation, must pay $35 in supervision fees, perform 35 hours of community service and pay the insurance premium of $7.50 and $200 in fines. He must also pay the cost of prosecution in the amount of $431.75.

The following individuals were accepted into the ARD program for DAI offenses: Heather Lorraine Crum; Ryan Paul Mehalko; Katelyn Roseanne Mohney; Richard A. Smith; Joshua Allen Krise; Richard W. Sarnoski; Jennifer Faith Zelinski; John Michael Holjencin; Matthew Jerod Rearick; and Eric Michael Mahovlich.

Robyn Leigh Scharf, 20, of Kersey was admitted into the ARD program for a charge of simple assault. She must pay $400 in fees, $35 in monthly supervision, perform 35 hours of community service and pay the $7.50 insurance premium. She must also pay $408.25 for the cost of prosecution.

Judge Richard Masson continued sentencing defendants Monday afternoon at the Elk County Courthouse.

Attorney Christopher Mohney made a motion for the materials used in conducting an assessment of Mark Alan Hutchins, 43, of Brockport. Proceedings against Hutchins were continued and will be rescheduled upon motion of either party.

Gina Marie Ritter, 25, of St. Marys, pleaded guilty to the charge of criminal conspiracy to commit contraband. She was sentenced to incarceration at Elk County Prison for a period of  no less than 12 months less one day and no more than 24 months less two days with credit for time served. She was also granted the potential for work release. She must also pay $35 supervision fees, a $500 fine, $250 for DNA testing and assessment, and $537.75 for the cost of prosecution. As a special condition of parole she must also continue to participate in substance abuses treatment.

Benjamin M. Goodrow, 27, of Ridgway, pleaded guilty to possession of drug paraphernalia. He was placed on probation for a period of 12 months and must also pay $35 supervision fees, $100 for Act 198, a $300 fine, and $285.75 for the cost of prosecution.

Cory Alan Cannella, 19, of St. Marys, pleaded guilty to one count of receiving stolen property. He was placed on probation for a period of 48 months and must also pay $35 supervision fees, a $500 fine, $250 for DNA testing and assessment, and $365.25 for the cost of prosecution. He must also pay restitution in the amounts of $200, $150, $3,824.48, $250, $2,478.85, and $426.55.

Stephanie Ann Kilhoffer, 49, of Ridgway, had sentencing continued until the Feb. 1 Return Day.

Scott Alan Beck, 27, of St. Marys, pleaded guilty to the charge of indecent assault. He was sentenced to incarceration at the State Diagnostic and Classification Center in Pittsburgh for a period of no less than one year to no more than two years with credit for time served. He must also pay $35 supervision fees, a $300 fine, $250 for DNA testing and assessment, and $330.25 for the cost of prosecution.

Eric John Leslie, 31, of Ridgway, pleaded guilty to one count of theft by deception. He was placed on probation for a period of 24 months to be served consecutive to a sentence imposed on June 22, 2009. He must also pay $35 supervision fees, a $150 fine, restitution in the amount of $202, and $327.25 for the cost of prosecution.

Leslie also pleaded guilty to another charge of theft by deception. For this offense he was placed on probation for 24 months to be served consecutive to the previously imposed sentence. He must also pay $35 supervision fees, a $150 fine, restitution in the amount of $99, and $327.25 for the cost of prosecution.

Brittnay M. Simbeck, 21, of St. Marys, pleaded guilty to retail theft. She was placed on probation for a period of 12 months and must pay $35 supervision fees, a $150 fine, and $335.35 for the cost of prosecution.

Gustavo R. Pino, 49, of Ridgway, pleaded guilty to corruption of minors. He was placed on probation for a period of five years and must pay $35 supervision fees, a $150 fine, and $335.75 for the cost of prosecution. As a special condition of his probation he must comply with the recommendations of Elk County Children and Youth Services and continue to attend drug and alcohol treatment sessions.

Christopher John Schatz, 38, of Kersey, will have his sentencing continued on Feb. 1.

John Scott Meiser, 39, of Mechanicsburg, will have his sentencing continued on Feb. 1.

Dustin Issac Rhoads, 23, of Penfield, pleaded guilty to the charges of firearms not to be carried without a license and terroristic threats. For the firearms charge he was sentenced to incarceration at Elk County Prison for a period of no less than 12 months less one day to 24 months less two days with credit for time served and the potential for work release. He must also pay $35 supervision fees, a $500 fine, $250 for DNA testing and assessment, and $335.25 for the cost of prosecution. He is also to have no adverse contact with the victim and forfeited the pistol for destruction. As a special condition of his parole he must also exert the necessary efforts to attempt to obtain his GED.
